Pon Di Stage User Agreement Last updated: June 8, 2009 Your Account If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Member Conduct You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not Pon Di Stage, are entirely responsible for all Content that you, post, email, transmit or otherwise make available on Pon Di Stage. Pon Di Stage does not control all the Content posted by their users and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Pon Di Stage website, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will Pon Di Stage be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available on Pon Di Stage. While using Pon Di Stage site, services and tools, you will not: - post false, inaccurate, misleading, defamatory, or libelous content (including personal information); - distribute or post spam, unsolicited or bulk electronic communications; - harvest or otherwise collect information about users, including email addresses, without their consent. - upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable; - harm minors in any way; - upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party; - upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except in those areas (such as shopping) that are designated for such purpose - upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; - use an anonymising proxy; Content If you do post content or submit material, and unless we indicate otherwise, you grant Pon Di Stage a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity Pon Di Stage has the right but not the obligation to monitor and edit or remove any content. Pon Di Stage takes no responsibility and assumes no liability for any content posted by you or any third party. Indemnity You will indemnify and hold us harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party. Changes To This User Agreement We reserve the right to update this User Agreement at any time.
